Minutes of the Ordinary Meeting of the Baw Baw Shire Council held in the

Trafalgar Chambers , commencing at 5.30pm  on 15 November 2017.

 

 

Present

1.      Opening and Recognition of Traditional Custodians

Ms Alison Leighton Chief Executive Officer, as the temporary chairperson opened the meeting with recognition of the traditional custodians being, I acknowledge the traditional custodians of the land on which we are meeting and pay my respects to their Elders both past and present.

 

2.      Reading of Affirmation and Prayer

Ms Alison Leighton read the Councillors affirmation, being, ‘We now pause to reflect upon the solemn responsibilities conferred on us by the Parliament of Victoria through the Local Government Act (1989). 

We acknowledge that it is the responsibility of local government to ensure the peace, order and good governance of our Shire. 

We are to be responsible and accountable to our community here in Baw Baw Shire through good governance and leadership. 

 Almighty God,

Give wisdom and understanding to the members of this Baw Baw Shire Council.

In all our deliberations help each of us to listen carefully, perceive the best course of action have courage to pursue it and grace to accomplish it.

purpose

Pursuant to Section 71 of the Local Government Act, Council are required to elect the Baw Baw Shire Council Mayor and Deputy Mayor for the 2017-2018 year.

REcommendation

That Council elect the Baw Baw Shire Council Mayor and Deputy Mayor for 2017-2018 year. 

 

Chief Executive Officer, Alison Leighton was the temporary chairperson of the meeting in accordance with the Meeting Procedure Local Law and called for nominations for the position of Baw Baw Shire Council Mayor.

 

Councillor Kostos nominated Cr Gauci for Mayor for 2017-2018.

Councillor Goss seconded Councillor Kostos’s nomination.

Cr Gauci stood and made made a ceremonial acceptance speech and spoke to his vision for the year ahead and Councils aspirations.


At 5.38pm Cr Gauci took the position as Chairperson and Ms Alison Leighton stood down from temporary chairperson.

 

Mayor Gauci called for nominations for Deputy Mayor for 2017-2018.

 

Councillor Leaney nominated Cr Goss for Deputy Mayor for 2017-2018.

Councillor Cook seconded Councillor Leaney’s nomination.

Key POINTS/Issues

Election of the Mayor and Deputy Mayor:

·        In accordance with the Local Government Act 1989, the Mayor is to be elected following the fourth Saturday in October but before the 30 November in each year.

·        Council has advertised to hold a Statutory Council Meeting on Wednesday 15 November 2017 to elect the Mayor and Deputy Mayor for the Baw Baw Shire Council for 2017-2018.

·        Prior to electing the Mayor the Council may, at its discretion, resolve to elect a Mayor for a term of 2 years; otherwise the term is for one year.

·        The proceedings of the Election are governed by Councils Meeting Procedure Local Law. Part 3 subsection 7 sets out the procedure for the Election of the Mayor detailing the process of nomination and election.

·        The Mayor must take the chair at all meetings of the Council at which he or she is present and at all municipal proceedings held within the municipal district. Refer Section 73 of the Local Government Act 1989.

·        The Chief Executive Officer will be the temporary Chairperson for the Meeting at which the election of the Mayor is held however has no voting rights.

·        The Chief Executive officer will invite nominations for the office of the Mayor and every nomination shall require a seconder.

·        Any Councillor is eligible for the election or re-election of the office of the Mayor. No division can be accepted for the election of the Mayor. Any Councillor nominated may refuse nomination.

·        If there is only one nomination received, the candidate nominated is declared elected. If there is more than one nomination, the Councillors present at the meeting must vote by show of hands.

·        If a candidate receives an absolute majority of the votes, that candidate is declared elected.

·        If no candidate receives an absolute majority of the votes, a candidate with the fewest number of votes is declared to be defeated candidate. The Councillors present at the meeting must then vote for one of the remaining candidates.

·        In the event of two or more candidates having an equality of votes and one of them having to be declared a defeated candidate or duly elected, the Chief executive officer must determine the result by lot.

·        The same procedures outlined above are required to be used to elect a Deputy Mayor.

·        The Chief Executive Officer will declare the result of the election and the successful candidate.

·        After the election and the Mayor is determined, the Mayor must take the Chair. Upon election, the Mayor may make a ceremonial speech. The purpose of the speech is to outline priorities for the year ahead based on the adopted Council Plan.

The election of the Mayor and Deputy Mayor is a statutory obligation under the Local Government Act 1989 and the undertaking of proceedings will be governed by Councils Meeting Procedure Local Law.

POLICY IMPACTS

The process of electing the Mayor and Deputy Mayor is consistent with Council’s policies and procedures.

Key POINTS/Issues

Appointment of Council delegates to Councils Advisory Committees:

·        After the election of the Mayor and Deputy Mayor has taken place, and the Mayor takes the position of Chairperson, Council will then move to the second agenda item which will be to nominate Councillor Delegates to Councils Advisory Committees.

·        A list of Councils Advisory Committees is attached and Councillors will be nominated against each.

·        Councillors represent Council on various bodies and community groups, and report back to the Council and community throughout the year on significant developments at Council meetings.

·        Councillors have the opportunity at this Statutory Meeting to nominate and one another and formally appoint councillors to the various advisory committees of Council.

·        An advisory committee is established under section 3(1) of the Act with the purpose of providing advice to the Council.

·        An advisory committee has no decision-making powers and the assembly of Councillors provisions and Meeting Procedure Local Law apply to an advisory committee at which a Councillor is present.

Financial Impact

There are no financial implications to the appointment of Councillor Delegates to Advisory Committees of Council.

There are no environmental implications noted.

·        Councillors and Advisory Committees form a vital role in helping inform Council of the community’s expectations and views on specific subject matters.

·        Each committee will be informed of the new or returning Councillor Representative as due process.
